Video Terms of Use — v 10.21.13
The unauthorized reproduction or distribution of this copyrighted work is illegal. Criminal copyright infringement, including infringement without monetary gain, is investigated by the FBI and is punishable by up to five years in federal prison and a fine of $250,000.
Notice: Receipt, possession, viewing, or any other use of this copy of any Applied Phlebotomy video (the “Video”) constitutes your agreement and acceptance (as “Licensee”) of these Terms of Use, unless you return the Video unused to the Center for Phlebotomy Education, Inc. (“CPE”) within 10 days after the date of the invoice for License fees (the “Invoice”) accompanying this copy of the Video by trackable means.
DEFINITIONS:
Academic institution— Academic program(s) on one or more campuses of an institution within a legally defined metropolitan area or county. Campuses of an institution in multiple legally defined metropolitan areas or counties are considered separate and distinct academic institutions for the purpose of these terms.
Healthcare Facility— one physical structure providing healthcare, including satellite facilities staffed by employees of the healthcare facility who perform blood collection procedures, but not clinical laboratory testing, on behalf of and upon request by, the healthcare facility.
Representative— employee of a corporation or organization whether located regionally (e.g., at corporate headquarters), intranationally, or internationally (e.g., members of a sales team).
Supportive Material— handouts in PDF format and continuing educational materials supplementing the Video. "Video"— Any content contained in or recorded on a DVD including but not limited to images, text, audio narrations, graphics, animations, and graphic animations.
Scope of License and Copyright Policy:
Videos are protected by United States copyright law and may not be reproduced, distributed, transmitted, simultaneously displayed on or accessible from multiple screens and/or monitors, or otherwise published. Purchasing one or more Videos from CPE includes a non-exclusive license (the "License") granted by CPE and required for display or viewing Videos as specifically permitted by the terms of such License as established herein. Licenses are not transferrable. The License is granted to Licensee only upon payment by Licensee of the license fees specified on the Invoice for license fees presented by CPE on the invoice or receipt generated at the time of purchase. The Invoice or Receipt constitutes proof of the license and lawful viewing of videos on the terms specified under these Terms of Use and in the License and should be retained by the Licensee. All material contained within a Video is intellectual property belonging solely to CPE. The content of a Video and the copyright therein is owned exclusively by CPE and is protected by U.S. and international copyright laws. All rights in a Video, including the rights to reproduce, transmit, and distribute this Video, are reserved exclusively to CPE. The medium upon which a Video is delivered (i.e., DVD) is also the property of CPE, and CPE reserves the right to reclaim physical possession of the medium in the event of a violation of the Terms of Use or of the License.
Video License
Viewing Videos requires purchase of a license. CPE grants a license to view and display Videos and supportive material to verifiable employees within their healthcare facility or verifiable employees and students in an academic institution. Verifiable employees and students are entitled to view the Video(s) licensed and print copies of supportive material. Recording reproduction, duplication, copying, distributing, republishing, translating, downloading, publicly displaying or providing access to non-subscribing Academic Institutions or Healthcare Facilities by any means is not permitted. Video(s) are not to be made accessible remotely to one or more remote computers through file sharing, virtual private networks (VPN), shared servers, remote desktops, or other web-based network connectivity platforms. In no circumstances may the Video be loaded onto a server for intranet or Internet distribution. (Contact the Center for Phlebotomy Education for a streaming option.) The information contained in the supportive material are for the personal use of the subscriber and the subscriber's verifiable employee(s) and/or student(s) and may not be incorporated into publications, databases, or software programs.
